Who is liable if you fell in a grocery store while shopping?

On Behalf of | Aug 4, 2018 | Premises Liability

Georgia residents are aware there are various hazards they could face when they go out in public, including dangerous property conditions. For instance, you may not have thought the grocery store was a dangerous place, yet if you fall while shopping, you could find yourself dealing with serious injuries. As a slip-and-fall accident victim, you may be unsure of who could be to blame.

Grocery store managers and owners have the responsibility of ensuring they clear their stores of any unnecessary hazards that could place customers at risk. If you were shopping and either tripped or slipped, you may not be to blame. Your accident could be the result of preventable hazards, and you could have grounds for a claim.

How do you know if you have a case?

Not every slip-and-fall accident will be grounds to move forward with a civil claim. Proving liability can be a complex legal matter, and many accident victims find it beneficial to reach out for help as soon as possible in order to understand their legal options. It may be possible the grocery store is responsible for your accident, but you will have to prove at least one of the following elements:

  • The property owner or an employee of the property knew about the hazard but did not take measures to fix it.
  • It would be reasonable to assume the property owner or his or her employee should have known about the hazard and addressed it.
  • The owner of the grocery store or an employee actually caused the hazard but did nothing to address it.

After a slip-and-fall accident, it is beneficial to take quick action in order to secure important evidence and begin working on a strong claim as soon as possible. You could have a rightful claim to financial compensation for your losses and injuries, and you have no time to lose.

What can you get from your claim?

A slip-and-fall accident may not seem that serious, but in reality, it can leave you with serious injuries, medical bills and ongoing health concerns. The impact can be significant, but you do not have to face it on your own.

Through a premises liability claim against the grocery store and/or owner of the store, you may be able to recover your financial losses and secure the financial support you need for various recovery needs and move forward after your premises liability incident in a grocery store.
