Sports stadiums can be the site for many preventable accidents, which, in turn, may lead to premises liability claims. Georgia residents may want to know about one such case where a man was assaulted just outside of Dodger Stadium back in 2015. His complaint was filed in 2017, and now the Los Angeles Superior Court has scheduled the case for mediation in February 2020.
The lawsuit alleges that the plaintiff was leaving Dodger Stadium around 10 p.m. when he was approached by two individuals, a 52-year-old woman and her son. The two began to shout vulgar language at him. Upon reaching the handicapped parking area, he was then physically assaulted by the two. He lost consciousness and continued to be kicked. He suffered a traumatic brain injury as a result.
It appears that the defendants were angry that the plaintiff’s cousin, who was accompanying him, wore a Mets cap; the Mets had won against the Dodgers that night. However, attorneys for the defendant claim that the plaintiff was drunk and attacked the 52-year-old woman, whereupon her son hit the man in defense.
The lawsuit also holds Los Angeles Dodgers LLC responsible. The area, it states, was poorly lit and without security. Though the incident occurred right outside stadium gates, security staffers did not arrive until several minutes afterwards.
Where preventable accidents are involved, victims may be able to seek compensation for their economic and non-economic losses. This might include medical expenses, lost wages, pain and suffering and emotional trauma. It may be wise to retain a lawyer, though. Premises liability lawyers may have a network of professionals to investigate an incident and gather proof that the defendant breached their duty of care. Lawyers may also handle all negotiations or litigate when negotiations fail to achieve a settlement.
