What You Shouldn't Say After An Accident

In the aftermath of a car accident, you might say things that will end up costing you money. For this reason, it's important to know the kinds of statements that can come back to haunt you.

In Georgia, the driver who causes an accident is responsible for paying for the damages of the driver and passengers in the other vehicle. Those damages can include medical bills, lost wages, pain and suffering, property damage, and other losses. Even if you think the other driver was primarily at fault, your recovery could be less if a percentage of the fault is assigned to you.

Following an accident, you should make sure everyone obtains needed medical attention. As a human being, you also want to respond sympathetically to an injured person. If a representative of the other driver's insurance company contacts you, your natural inclination is to be cooperative. However, your natural inclinations can work against you in personal injury litigation.

Here are examples topics you shouldn't do:

  • Discuss fault. Even a minor statement such as I should have been more watchful or I might have been going a few miles over the speed limit could result in a percentage of the fault being assigned to you.
  • Provide a recorded statement. The insurance company of the other driver may ask you to provide a recorded statement about how the accident happened. You should not. Insurance adjusters are experienced at getting people to say things that will damage their case. For example, you may be asked to describe the accident a number of times. If you vary in any detail, the insurance company may accuse you of changing your story.
  • Discuss your injury. You may not feel the pain of an injury immediately after an accident. Make sure you are all right before you say anything.

The best way to protect your right to full compensation after an accident is to seek prompt legal advice from a lawyer who handles personal injury cases. Most personal injury law firms provide a free initial consultation.

The law firm of Isenberg & Hewitt, PC handles serious personal injury cases involving motor vehicle accidents in the Atlanta metro area.
