Inadequate security potential factor in parking lot game injury

A man who was recently hospitalized for injuries that he sustained during a brawl during the recent Florida-Georgia football game may have a case against the stadium for premises liability, based on inadequate security.

The fight wound up near the retention pond and was witnessed by a crowd of onlookers. Some of the witnesses said that the victim seemed to be intoxicated before the fight. According to witnesses, the victim seemed unable to defend himself and said the man was being "beat down." No weapons were involved, but the man was taken to a nearby hospital with life-threatening injuries. His condition was later upgraded to stable.

This incident was not the only one that has led to serious injuries around the time of the game, which takes place annually in Jacksonville, Florida. In 2004, a student died when he fell from a parking garage. In 2005, a student was beaten to death after the Florida-Georgia game.

If a person is injured while on the property of another, or if a loved one is killed, the victim or his family may have the right to sue the negligent property owner. Landowners are generally expected to maintain the premises. Some businesses or organizations are expected to display ordinary care and may be expected to have more security around an area where emotions are heated.

Because the game brings together roughly equal numbers of fans from the two schools whose emotions can run high, the landowner may have had notice that a situation like this had the potential to occur. A premises liability attorney can investigate the business or organization that is responsible for maintaining the premises in order to determine if the owner breached his duty of care.
