Driver Tony Stewart faces wrongful death suit

Georgia residents might be interested in learning more about the wrongful death suit filed against NASCAR driver Tony Stewart. In August 2014, Stewart was involved in an accident that left another driver dead during the Empire Super Sprints race at a raceway in Canandaigua, New York. During the race, Stewart and the man's car collided, which led to the other driver getting out of his car

The other man then walked onto the race track where he collided with Stewart's car. He was pronounced dead about 45 minutes after the crash with the official cause of death determined to be blunt force trauma. Although he was not charged with a crime, the lawsuit states that Stewart gunned his engine, which caused the car to slide. The man was then hit by the rear right tire and thrown 25 feet.

It further claims that the crash would not have happened if Stewart had acted in a reasonable manner. Although the family is suing for financial compensation, the exact amount they are requesting was not revealed. Under New York law, parents may be compensated for the loss of care that a child may have provided in the future. However, the parents are not able to directly ask for compensation related to their own emotional pain and suffering.

If an individual is killed while on another person's property, it may be possible to file a wrongful death suit. An attorney might be able to examine the case to determine whether the owner was at fault or if the individual who committed the act had the relevant duty of care. Family members may be able to collect compensation for final expenses and lost earnings as part of their lawsuit.
