Auto/Truck Accident Cases
Babayeva v. Ake & Borukhov - Backseat passenger broke her jaw on head of other backseat passenger. Jury trial in Cherokee County State Court. Verdict $78,085.55 (+ $7,500.00 for passenger #2 with minor soft tissue injuries).
Bailey v. Weldon - Plaintiff suffered permanent impairment to her arm in motor vehicle accident. Case settled after State Farm tendered the policy limits of $100,000.00.
Godfrey v. Maney - Plaintiff was an adult male who was sitting on an ATV off the shoulder of a rural road. A drunk driver lost control while traveling recklessly around a corner of the road. The defendant’s vehicle struck the ATV and the plaintiff incurred a rotator cuff tear resulting in permanent restriction of movement to the plaintiff’s dominant arm. The defendant had no insurance and was defended by the plaintiff's Uninsured Motorist Insurance Carrier, State Farm. After a two-day bench trial a verdict of $296,000.00 was awarded to the plaintiff.
Juarez v. Digitel Corp - Plaintiff suffered severe injuries to his arms and legs in a motor vehicle collision rendering him a quasi-paraplegic which was arguably treatable through extensive physical therapy. Case settled immediately prior to trial for $706,503.00.
Kucheryaavy v. Doe - Plaintiff was involved in motor vehicle collision with an unknown, uninsured motorist. Plaintiff suffered broken ribs and multiple contusions. The case was tried to a jury in Gwinnett State Court. After two days of trial and one hour of deliberation, the jury awarded the plaintiff $88,000.00.
Popovic v. USA & Lerch - Plaintiff slipped and fell at a United States Post Office and suffered a broken wrist. Before that claim was resolved, the plaintiff was involved in an automobile collision that aggravated her condition. Plaintiff subsequently developed tendinitis (tennis elbow). The case settled for $148,000.00 following a settlement conference with the federal district judge presiding over the two cases.
Smith v. Commercial Transport - Action on behalf of an estate against a trucking company where the truck driver was responsible for causing all lanes to be blocked. Driver of the deceased's vehicle struck a different tractor-trailer from the rear which was stopped in the highway approximately 3 miles behind the site of the initial accident. As a result of the negligence of the initial truck-driver’s negligence resulting in the 3-mile back-up of traffic, the case against the initial driver causing the back-up settled for $925,000.00 after the Court of Appeals reversed the defendants' motion for summary judgment.
